Terms of service

Scope of Work - DUEL

Welcome to the REFY Curators Program.

This is a collaboration between you and REFY, we can't wait to see what you create. Please read and sign the contract below in order to continue. Once you have completed your first tasks, you will receive a £50 voucher.

Scope of Work

  1. Applicants must be signed up for the REFY Curator Program and participate in required tasks to be able to receive rewards, product vouchers, and have the chance to be featured on REFY digital and social channels.

    • REFY requires Curators to post at least one time on their IG Grid or a TikTok post within 30 days of receiving their REFY products purchased with vouchers that are acquired through this programme.
    • Curator content can be used by REFY across @refybeauty social channels, paid media channels (including but not limited to Meta & TikTok), email marketing, web, and across 3rd party retailers from delivery in full perpetuity. Curator content can be used by REFY for marketing purposes outside of its original form. For avoidance of doubt, this means that the brand may minimally edit, shorten, and compile the content in order to repurpose this.

  2. After your first post goes live, you are able to take part in as many tasks as you please in order to level up within the programme.

    • Each task rewards you with points which enable you to level up through each tier of the program.
    • Each time you level up, you unlock new rewards and exclusive community perks.

Content Guidelines & Expectations

  • All social media posts must include tags to all relevant REFY channels (@refybeauty).
  • Avoid other competing/other makeup brands to be featured.
  • Background must be clear and not distract from the product featured.
  • Lighting must be bright/natural/neutral toned and must not distort/effect the visual quality/makeup.
  • No use of heavy face filters/filters that distort/effect the visual quality/makeup.
  • Products must be shown clearly & clear application of the products must be shown on camera.
  • Clean products/tools should be used.
  • Content should be in line with and to the same standard as Curators' existing content.
  • Please refer to the ‘Content Best Practice Guide’ within the programme or @refybeauty social channels for more guidelines.

Welcome Voucher

  1. In exchange for Curator signing the contract and completing the required tasks, REFY will provide Curators with a product voucher worth £50/$60.
  2. Curator acknowledges that in exchange for the Welcome Gift, they are required to post at least once within 30 days as outlined in the Scope of Work.
  3. Applicant is liable for the full cost of the product if the applicant does not meet the posting requirements within 30 days.

Term and Exclusivity

  1. This agreement shall commence on the date the applicant signs up for the REFY Curator program and shall remain in force until the applicant completes all items set out in the Scope of Work or is otherwise terminated as provided for in the Termination Clause.
  2. This agreement is a non-exclusive agreement and shall not prevent the Curator and their social media platforms from performing any services for any other party including other beauty or makeup brands.

Relationship of Parties

  1. Nothing in this Agreement shall create an employment relationship between Curators, its agents, or employees and REFY.
  2. The terms of this agreement, contract, and content of the REFY Curator Programme including Tasks will remain confidential between the Curator and REFY.
  3. All contents and ingredients are clearly stated on the refybeauty.com website and packaging of products. Please check these for any allergens you are aware of. REFY is not liable for any reactions or outbreaks in relation to these products.

Force Majeure

Curators shall not be liable for any failure or delay in performing any of its obligations under the Agreement, due to any causes such as acts of God, pandemic, failure of public transportation, actions by governmental authorities (whether valid or invalid), fires, terrorist acts, riots, floods, earthquakes, windstorms, or other natural disasters, wars, embargos, or labor strikes (whether legal or illegal), insurrection, power failure, labor material shortage, illness, death in the family, or any other condition beyond the control of such party affecting production or delivery in any manner. The affected party shall notify the other party of any such event and use its good faith efforts to minimize the effects of such an event and resume performance as soon as possible.

Termination

You or REFY can delete your REFY Curator account at any time. Your partnership may be terminated by REFY if:

  1. You fail to post at least once on your IG Grid within 30 days after receiving your REFY product. Your account is inactive for a period of 6 months or longer.
  2. You sell, transfer, license, or assign your rewards, account, submissions, reward credits, loyalty points, or any account rights (or attempt to do any of the same) to anyone other than yourself.
  3. You fail to meet the program expectations, which may include but are not limited to:
    • Posting or submitting content that is of low quality.
    • Posting or submitting content that doesn’t adhere to brand content guidelines and expectations.
    • Posting or submitting content that doesn’t meet the terms outlined in the Scope of Work.
    • Curator is found to have sold gifted pieces attained through this programme for monetary value.
    • Posting harmful, offensive, or illegal content.

As a member of REFY Curators, you agree that any content you submit to the program may be used and re-purposed by REFY for promotional, marketing, and advertising purposes, both online and offline, without any compensation beyond the benefits provided as part of the REFY Curators Programme.

Wherever possible, REFY will credit you as the creator of the content by using your social media handle, name, or username. However, due to technical limitations or space constraints, explicit attribution may not always be possible.

Please confirm you have read and understood our Scope of Work and therefore acknowledge our expectations of you as a REFY Curator by joining the programme.
